By now you have gotten several messages from the university regarding the implementation on July 7, 2002, of the new Public Access to Government Records Law. The university has established a website with information concerning the law and how the university will process requests for records at: http://records.rutgers.edu.

This law does NOT superseded other NJ state laws regarding the confidentiality of certain records, including access to circulation and other user records, which remain confidential and for which we have separate procedures.

We will be providing educational programs for everyone regarding access to information and records, but we want you to be aware of the following:

1. Many, but not all, records of the university and its departments may now be requested by the citizens of New Jersey under this new law.

2. The University has established a position, University Custodian of Records, to whom ALL requests for university records under this law must be sent.

3. All requests for records must be in writing.

4. ONLY the University Custodian of Records may determine whether a record may be released to the public or not.

5. The Office of the University Librarian will be the official conduit for receiving requests from the University Custodian of Records to locate records within the Libraries.

6. If you receive a request from the Office of the University Librarian to locate specific records you are to give it top priority, as there are time lines specified in the law.

7. Under no circumstance are you to respond directly to a request by the public for library records under this law. You should direct the requestor to put the request in writing and to forward it to the University Custodian of Records, 85 Somerset Street, New Brunswick, NJ 08901; 732-932-8325, 732-932-7956, records@rci.rutgers.edu, or the university website: http://records.rutgers.edu

It is too early to know the full ramification of this law, so should you have any questions please refer them to my office. Further information and training is forthcoming.

The Libraries would like to designate Janie Fultz, Assistant to the University Librarian, as the primary contact for requests for records under the Public Access to Government Records Law. This includes requests for all campus libraries, excluding the law libraries.
